    Witness grilled about repeatedly delaying court proceedings

    When the attorney for murder suspect Martin Wallace Yuen questioned the dead victim’s brother on Monday, she treated him with kid gloves.

    But the gloves came off on Tuesday after Dwayne Crazyboy failed to return to the witness stand to continue his testimony and it took an arrest warrant to bring him to court.

    Defense attorney Rebecca Snukal grilled Crazyboy about why he wasn’t available to take the stand when Yuen’s trial resumed at 10 a.m.

    “How come you came to court a few minutes ago?” Snukal asked as the courtroom clock struck 15:36

    “I fell asleep, right,” Crazyboy replied.

    “I knew I was late… I apologize.”

    But Snukal persisted in pointing out that Crazyboy has repeatedly delayed proceedings before a now 11-member jury since he first took the stand last Friday.

    “Mr. Crazyboy, you arrived here this afternoon because you arrived here on a witness warrant, correct?”

    “Yes,” he replied.

    The lawyer took note of information that at 10:20 am. was provided, indicates that Crazyboy left his residence to come to court five minutes earlier.

    “I was up, right, and I fell back,” he explained why his wife indicated he was on his way.

    Crazyboy indicated that he got up in the afternoon and was about to go to court when the police arrived at his residence shortly before 3:00 p.m.

    “You were arrested in your garage,” Snukal pointed out.

    “When I was sitting in the vehicle, they knocked on the door,” he said.

    “I was on my way here anyway,” Crazyboy said.

    “No, you weren’t,” Snukal challenged.

    “Yes, I was.”

    The lawyer noted that the arrest warrant was the second one issued to bring Crazyboy to court after he left the Calgary Courts Center in the middle of his testimony Friday afternoon.

    John Edward Tabler is charged with second-degree murder in the death of George, who died on Memorial Dr. SE was shot outside Yuen’s house.

    Crazyboy testified that he and his brother went to the boarding house to pick up a litter of puppies, but Yuen said George was not welcome there.

    He told Snukal that her client repeatedly told George to leave, but he wouldn’t, even after Yuen pulled out a gun and threatened to shoot him.

    Crazyboy said Yuen eventually got his brother out of the house and as he and Tabler chased him, Tabler, who had been given the gun by Yuen, fired a single shot into George’s neck.
